Thank you for your interest in the 1965 Group, LLC d/b/a APA Tournaments, Amateur Pickleball Association (the “Company,” “we,” “us,” or “our”). This is the privacy policy (the “Policy”) that governs how we use Personal Information (defined below) that we collect, receive and store about you in connection with the use of our website, www.apatournaments.com, as well as any other website or mobile application(s) that we may operate (collectively and together with any subdomains and the content and services therein, the “Website”). Certain portions of our Website are used by children and the section entitled “Children’s Privacy” herein details how we collect, use and store children’s Personal Information in connection therewith. 

We value and respect your privacy and protecting your information is important to us. This Policy explains how we handle the collection and use of Personal Information that we obtain and the choices that you can make about how your Personal Information is used by us. “Personal Information” means any information that can be used, alone or in combination with other information, to personally identify an individual, including, but not limited to, a first and last name, email address, or other personal profile. In some cases, IP addresses may also be considered Personal Information.

Consent and Modification

We encourage you to review this Policy periodically, as your use of our Website and related services constitutes consent to this Policy. We may periodically update this Policy, and any changes will be reflected here. If we make any significant changes, or any changes with respect to our collection or handling of children’s Personal Information, we will provide a more prominent notice, and at our discretion may email you directly with information on the same. If you do not agree with the practices described in this Policy, you should not use our Website or the services, or otherwise interact with the Company.

What We Collect and How We Collect It

In order to participate in or receive updates about one of our tournaments, you are required to register an account (“Account”). Establishing an Account requires you to provide your first and last name, email address, phone number, mailing address and date of birth. Parents or legal guardians can also register an Account for minor children, and such Accounts require the above information as well as the first and last name and date of birth for the child (see the Children’s Privacy section below for additional information on our handling and use of the Personal Information of children). When you establish an Account, you will also specify a username and password, which should only be known to you. 

If you would simply like to receive updates and information from us, but are not yet ready to establish an Account, you can sign up to receive updates by sharing your name and email address with us. We do not require an Account, nor do we require that you provide any Personal Information, in order to access the general information on our Website.

If you provide any additional Personal Information beyond what we require, such as in your communications with us, doing so is entirely your choice. We will retain the Personal Information that you choose to provide in those instances.  

We also collect certain data and information about you automatically when you visit our Website. This data may include your IP address, the time and date of your visit, your location, the pages and other content that you access, and the number of times you return to the Website. Collection may be performed by the Company directly or through our integrations with technology provided by third parties, such as Google Analytics. We collect this information using automated tools and technologies such as:

Log Files. A log file is a text file which resides on our servers, and which records pertinent information about your interactions with our Website at the time of access. Log file data is used primarily for diagnostic and auditing purposes.

Cookies.  A “cookie” is a small data file transmitted from a website to your device’s hard drive, and which allows us to recognize you as a user when you return using the same device or web browser. Cookie data is used to customize your experience when you use our Website. Cookies are usually defined in one of two ways, and we may use both of them: (1) session cookies, which do not stay on your device after you close your browser, and (2) persistent cookies, which remain on your device until you delete them or they expire.  You can configure your web browser to warn you each time a cookie is being sent or to refuse cookies entirely. However, if you opt to refuse cookies created by our Website, you accept that your ability to use our Website and services may be impaired or limited, up to and including loss of access to certain functionality, until such time as you accept these cookies. We use the following categories of cookies on our Website.

  • Strictly Necessary Cookies.  These cookies are essential in order to enable you to move around the Website and use its features. Without these cookies, services you have requested, such as maintaining a record of your purchased items (e.g. a shopping cart), cannot be provided. 
  • Performance Cookies.  These cookies collect anonymous information on how people use our Website to help us understand how you arrive at our site, browse or use our Website and highlight areas where we can improve, such as navigation. The data stored by these cookies never shows personal details from which your individual identity can be established. 
  • Functionality Cookies.  These cookies remember choices you make such as the country from which you visit our Website, your preferred language, and your search parameters. This information can then be used to provide you with an experience more appropriate to your selections and to make your visits to our Website more tailored to your preferences. The information in these cookies may be anonymized. These cookies cannot track your browsing activity on other websites.  For example, we use WordPress “Comments Cookies” that set a cookie on your device when you leave a comment on our Website (which is created on the WordPress platform). The WordPress Comment Cookies are used to remember you so that the values are automatically filled in the corresponding fields and the you do not have to enter your details every time you want to leave a comment.

Embedded Web Links.  Links provided in our emails and, in some cases, on third-party websites may include tracking technology embedded in the link. The tracking may be accomplished through a redirection system. The redirection system allows us to understand how the link is being used by email recipients.  Some of these links will enable us to identify that you have personally clicked on the link and this may be attached to the Personal Information that we hold about you. This data is used to improve our services and to help us understand the performance of our marketing campaigns.

Embedded Scripts. An embedded script is programming code (particularly JavaScript) that collects information about your interactions with our Website. The code is temporarily downloaded onto your device, from our server or a third-party service provider, and is deactivated or deleted when you disconnect from the Website. You can configure your web browser to disable the use of embedded scripts. However, if you opt to disable embedded scripts which we incorporate into our Website, you accept that your ability to use our Website may be impaired or limited, up to and including loss of access to certain functionality, until such time as you enable these embedded scripts.

We may also use other technologies that collect similar information for security and fraud detection purposes.  

Children’s Privacy

The Company is dedicated to the growth of the sport of pickleball within the youth and college student demographic and in connection therewith, we collect the Personal Information of children from time to time. We do not knowingly collect any Personal Information for children under the age of 13 without parental consent. If we learn that a child under the age of 13 has provided us with Personal Information absent parental consent, or that such Personal Information has otherwise been inadvertently collected, we will delete it in accordance with applicable law, including the Children’s Online Privacy Protection Act. 

When we do collect Personal Information from a child under the age of 13, we do so only from, and with the consent of the child’s parent, guardian or another person with such authority (collectively, the child’s “Parent”). By consenting to the collection of a child’s Personal Information as a Parent, you: 

  • Represent and warrant that you have the legal authority to provide consent for and act on behalf of the child; 
  • Authorize the Company to use and otherwise process the Personal Information of the child in accordance with this Policy, and for the purposes provided; and
  • Agree to indemnify and hold the Company harmless against any misuse of our services by the child, or by any other third party. 

Children’s Personal Information We Collect and How We Collect It

We collect the following Personal Information from children: first and last name, and date of birth. All Personal Information is collected directly through our Website via direct input by the child’s Parent. We only collect children’s Personal Information as is reasonably necessary in connection with the provision and hosting of pickleball tournaments. We only retain children’s Personal Information for as long as is necessary to provide the same, and when it is no longer necessary then the Personal Information will be deleted. 

How We Use Children’s Personal Information

We use children’s Personal Information to register for, seed and conduct pickleball competitions nationwide, each time at the express authorization and direction of the child’s Parent. We also use children’s Personal Information to communicate with you in regard to the same and to report tournament results to the USA Pickleball Association (USA Pickleball) and other sanctioning bodies. We do not use children’s Personal Information for any other purpose.

Sharing Children’s Personal Information 

We share the Personal Information of children that we collect with competition participants, directors, officials and volunteers, as applicable. 

We may also share pertinent Personal Information of children with certain contractors, vendors, affiliates and other partners, at all times subject to appropriate contractual obligations of confidentiality and non-disclosure, for the authorized purposes of processing data for research, analytics, customer support and account management.

Parent’s Choices and Accuracy of Children’s Personal Information We Collect

As a Parent, you always have the right to withhold your consent and prevent us from collecting Personal Information on or from your child. You may also request a copy of what Personal Information we have collected on or from your child at any time upon request. You can instruct the Company to amend or delete your child’s Personal Information at any time, or withdraw your previously given consent for the further collection or use of your child’s Personal Information. You may also instruct us, in certain circumstances, to restrict the use or processing of children’s Personal Information.

Likewise, you always have the choice whether or not to provide any other Personal Information to us. As indicated above, some of our offerings, such as competitions, require that you register with us and establish an Account or that information be shared with sanctioning entities, but doing so is entirely at your discretion. If you choose not to provide required Personal Information at any step, you can still use any portion of our Website or services that do not require Personal Information. 

If you do provide us with Personal Information, we want to make sure it remains accurate and up to date. You can use the tools that we make available through our Website to modify or remove certain information related to your child’s Account. If you need to update or correct any other part(s) of your child’s Personal Information, you can submit a change request directly by emailing us at davidson@apatournaments.com. Please be sure to include sufficient details to allow us to make the necessary changes. 

How We Use Your Personal Information

As noted above, we only use children’s Personal Information for the purposes set forth above, each time at the express authorization and direction of the child’s Parent. 

We otherwise use Personal Information primarily to provide information and activities regarding pickleball, including to conduct tournaments. Such use may include, but is not limited to, logistics, responding to inquiries, providing customer services and sending administrative information. We may use Personal Information to contact you in the future to tell you about new offerings, promotions, opportunities and/or other general information about pickleball or the Company that we think you might be interested in. 

We also use the Personal Information we collect to improve our Website. We review information to learn about how our Website is used and accessed, and to analyze user behavior as a measure of interest in and use of our Website. We may disclose such analyses to third parties in the form of aggregate data, such as overall patterns or demographic reports that do not describe or identify any individual user. We may also use certain subsets of the same information to investigate and prosecute potential breaches of our applicable license agreements and security policies. We also may share pertinent Personal Information with our contractors, vendors, and other affiliates and partners for the authorized purposes of processing data for marketing, research, analytics, customer support and account management.

If you provide any information, whether or not it is Personal Information, via any interactive features of the Website, or through any social media platform that we link to, you should be aware that the information you provide could be available to others, whether immediately or at some future point. If you contact us by email, please be aware that we cannot guarantee total security of email transmissions, and that what you email to us could possibly be viewed by a third party while in transit. When caused by errors, by the unauthorized acts of third parties during transmission, or by interaction with a website other than Company’s, we have no liability for disclosure of any information.

Though it is not often necessary, we reserve the right to disclose Personal Information to third parties to protect the rights, property or safety of the Company, our employees, or others.

Other Disclosures of Personal Information

We do not sell, trade, share or rent your Personal Information to unaffiliated third parties for marketing purposes.

We will not disclose your Personal Information to any third party except as necessary for a legitimate use as described herein, in connection with a bona fide legal dispute (where the information is relevant and in response to a valid, compulsory legal process) or as otherwise required by law. 

In the event of a merger, acquisition, bankruptcy, or other sale or disposition of all or a portion of our assets, we may disclose Personal Information to the acquiring party(s). In that case, the successor’s use of your Personal Information will continue to be subject to this Policy unless a court orders otherwise or the successor notifies you that your Personal Information will be subject to their own privacy policy. If the successor sends you such a notification, it will include an opportunity for you to opt out. If you submit any Personal Information after such a transfer, that information will be subject to the successor’s privacy policy.

Your Choices and Accuracy of Personal Information

You always have the choice whether or not to provide Personal Information. As indicated above, you may be required to register an Account to take part in portions of our services, but doing so is at your discretion. If you choose not to provide required Personal Information, you can still use any part of our Website that does not require Personal Information.

If you do provide us with Personal Information, we want to make sure it remains accurate and up to date so that we can provide you with relevant information that you have requested. You can use the tools that we make available through the Website to modify or remove certain information related to your Account. If we provide subscription-based services, such as email newsletters, we will allow you to make choices about what information you provide at the point of information collection or at any time after you have received a communication from us while you are subscribed. We will not intentionally send you email newsletters and marketing emails unless you consent to receive such marketing information.  After you request to receive these emails, you may opt out of them at any time by selecting the “unsubscribe” link at the bottom of each email.  Please note that even if you opt-out, you may still receive transactional or service-related messages from us as reasonably necessary.

Third-party Websites 

This Policy does not apply to websites or other domains that are maintained or operated by third parties or our affiliates.  Our Website may link to third-party websites and services, but these links are not endorsements of these sites, and this Policy does not extend to them.  Because this Policy is not enforced on these third-party websites, we encourage you to read any posted privacy policy of the third-party website before using the service or site and providing any information.  

Information Security

The Company uses commercially reasonable security and backup measures to protect the information submitted to us. No method of transmission over the Internet or method of electronic storage and security is 100% secure, though. While we always strive to protect your Personal Information, we cannot guarantee its absolute security. We encourage all our users to retain copies of all uploaded information on their own systems, to adhere to all corporate security policies or guidelines pertinent to your situation, and to practice personal habits of digital security.

California Privacy

California residents have additional rights regarding the privacy and disclosure of Personal Information, including, but not limited to a right to request that we not sell their Personal Information, as well as a right to be informed about our other uses and disclosures of their Personal Information.

California law requires websites to disclose whether they and/or any third party(s) collect Personal Information about their users’ online activities over time and across different sites. California law also requires that we disclose how we respond to “do not track” signals and similar mechanisms.

Our Website is designed for use by individuals in the United States only.  We do not warrant or represent this Policy or our use of your Personal Information complies with the laws of any other jurisdiction.  Furthermore, to provide you with our services, we may store, process, and transmit information in the United States and other locations around the world, including countries that may not have the same privacy and security laws as yours.  Regardless of the country in which such information is stored, we will process your Personal Information in accordance with this Policy.
